Jane Odell, Penybryn, Llannor (Traeth Pwllheli), Widow : Will 1853.
This is the last Will and Testament of me Jane Odell of Penybryn in the Parish of Llannor in the County of Carnarvon, Widow.Whereas by a certain indenture or deed of settlement and declaration of trust dated the nineteenth day of April one thousand eight hundred and thirty made between Charlotte Weston, Widow of the first part, Elizabeth Ellis, Widow, (since deceased), Elizabeth Mary Ellis, Spinster, Ellen Ellis, Spinster, John Williams, Farmer and Frances Jane his wife, Robert Edwards, Surgeon, and Mary his wife (since deceased) and William Odell, Gentleman (since deceased) and I the said Jane Odell his wife of the second part and Cyril Williams and Griffith Jones and the survivor of them, his Executors administrators and assigns.
In trust to lay out and invest the same on the securities and in the manner therein mentioned and to pay the Interest dividends and annual proceeds thereof to me the said Jane Odell - during my life and after my decease upon trust to pay and transfer the same and every part thereof unto such person or persons for such Interest or Interests and upon such trusts and in such manner and form in all respects as I the said Jane Odell by my last Will and Testament in writing or any codicil or codicils thereto signed in the presence of and attested by two or more credible witnesses should give or bequeath the same and in default of such gift or bequest then upon certain trust therein mentioned.
And whereas the said Cyril Williams and Griffith Jones in or about the month of December one thousand eight hundred and thirty nine - invest the said sum of two hundred and twenty pounds in the purchase of Interest or share in the Capital or joint stock of three pounds ten shillings per centum reduced annuities and whereas the said Cyril Williams and Griffith Jones in or about the month of April one thousand eight hundred and forty one sold out the said Interest or share in the said capital or joint stock of three pounds ten shillings per centum reduced annuities and in consequence of a fall then in the price of the said capital or joint stock and after deducting thereout commission and other expenses the same only realised the sum of two hundred and sixteen pounds sixteen shillings and sixpence sterling, at which amount the said trust money now stands and is now secured by a mortgage of freehold property in the names of the said Cyril Williams and Griffith Jones.
Now in the exercise and execution of the power or authority given or reserved to me by the said in part ? Indenture are of every or any other power or authority enabling me in this behalf I the said Jane Odell by this my last Will and Testament in writing signed by me in the presence of and attested by the two credible persons whose names are hereunto subscribed as witnesses attesting the same do give and bequeath the said sum of two hundred and sixteen pounds, sixteen shillings and sixpence the present amount of the said trust money to my Nephews, Robert Williams, John Williams, William Williams, Robert Edwards and John Edwards and my Nieces Ellin Williams, Frances Williams, Elizabeth Williams, Mary Edwards and Ellin Edwards, being respectively the sons and daughters of my sister Frances Jane Williams and of my late sister Mary Edwards, share and share alike.
As to all sum and sums of money now due and owing to me at my decease on Mortgages Bonds Promissory Notes or other Securities or invested in the public funds or lodged at any bank and also my distributive share of the personal estate and effects of my late Cousin Ann Eleanor Smith I give and bequeath the same and every part thereof to my Nephew Thomas Ellis of Pwllheli, in the said County of Carnarvon, Attorney at Law, his Executors administrators and assigns upon the several trusts and to and for the several ends intents and purposes hereinafter declared concerning the same (that is to say) upon trust thereout in the first place to pay and satisfy all just debts which I may owe at my decease and my funeral and testamentary expenses and do and shall at the expiration of six calendar months next after my decease pay thereout the sum of fifty pounds to and amongst my said Nephews. Robert Williams, John Williams, William Williams, Robert Edwards and John Edwards, share and share alike, and do and shall at the expiration of six calendar months next after my decease pay thereout the sum of one hundred pounds to and amongst my said Nieces, Ellin Williams, Frances Williams, Elizabeth Williams, Mary Edwards and Ellin Edwards, share and share alike.
And do and shall layout and invest the residue or surplus thereof after paying and satisfying the debts expenses and legacies aforesaid in his or their own name or names in the parliamentary stocks or public funds of Great Britain or at interest in Government or real securities in England or Wales or on good personal security or permit and suffer the same or such part thereof as may not be required for the purposes aforesaid to remain on such securities as the same may happen to be secured on at my decease in case the said Thomas Ellis shall consider the same safe and sufficient and do and shall yearly and every year pay the interest dividends and annual proceeds thereof to my sisters Elizabeth Mary Ellis and Ellen Ellis for and during the term of their natural lives and the life of the survivor of them and from and immediately after the decease of the survivor of them, then upon trust that he the said Thomas Ellis do and shall retain and keep the said residue or surplus of the said trust monies so directed to be laid out and invested as aforesaid and the interest and dividends thereof and the stock funds and securities in or upon which the same may be invested or secured to and for his own absolute use and benefit and apply and dispose of the same at his own free will and pleasure.
I give and bequeath my gold chain and locket to my sister in law Mrs Eleanor Ellis of the Lodge, Pwllheli.
As to the rest residue and remainder of my personal estate and effects of every description I give and bequeath the same and every part thereof to my said Nephew Thomas Ellis absolutely and I do hereby nominate constitute and appoint my said Nephew Thomas Ellis Sole Executor of this my last Will and Testament hereby revoking and making void all Wills and Testaments by me at any time heretofore made and declare this to be my last Will and Testament. In witness whereof I the said Jane Odell the Testatrix have hereunto set my hand and seal the first day of May in the year of our Lord, one thousand eight hundred and forty eight.
Signed sealed published and declared by the said Testatrix Jane Odell (the words “widow” “or on good personal security” having first been initialised therein) as and for her last Will and testament in the presence of us who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses. On the thirtieth day of March in the year of our Lord one thousand eight hundred and fifty three the above Will was insinuated proved approved and in common form of Law decreed valid and Administration granted to the above named Executor, Thomas Ellis, he being first sworn in common form of Law and that the whole of the Goods Chattels and Credits of the said deceased do not amount in value to £1500.
